The Pentel HyperG “Smoothest Line” Contest Official Rules

No Purchase or Payment Necessary to Enter or Win. Eligibility: The Pentel HyperG “Smoothest Line” Contest (hereafter, “Contest”) is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older as of date of entry. Employees, officers, directors, agents and representatives of Pentel of America, LTD (hereafter, “Sponsor”), Project Support Team, Inc. and each of their respective parents, affiliates, subsidiaries, wholesalers, retailers, distributors, suppliers, advertising, public relations and promotion agencies (hereafter collectively, “Released Parties”), and each such individual’s immediate family members (mother, father, sister, brother, child, husband, wife and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win. Void where prohibited by law. All applicable federal, state and local laws apply.

Promotion Period: Contest Entry Period begins 12:00:00 am Pacific Time (“PT”) on 8/15/08 and ends 11:59:59 pm PT on 9/30/08 (hereafter, “Promo Period”).

To Enter: During the Promo Period, visit www.yoursmoothestline.com & follow the directions provided to complete & submit the Official Entry Form, which includes Your Smoothest Pick-Up Line (hereafter referred to as an “Entry”). Pick-Up Line must be twenty (20) words or less (counting all words including “I”, “a”, “the”, etc.). Limit one (1) entry per person & per email address. Entry cannot have been previously published or submitted in any competition and must be: (i) complete; (ii) in English; (iii) your original creation; and (iv) cannot defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights. Modification of an existing work does not qualify as original. Entries that are deemed by the judges in their sole discretion to be immoral, obscene, profane or not in keeping with Sponsor’s image or in violation of these Official Rules will be void. Additional optional Entry materials you will be asked to upload are as follows: (1) photo of yourself, in JPEG, PNG or GIF format, no larger than 2MB; photo must be of you alone, no other persons may appear; (1) video of you “delivering” your smoothest line, no longer than 60 sec., in MP3 or Quicktime format, no larger than 5MB; and (1) essay of no more than 100 words, describing when and how you have used your smoothest line. All restrictions above relating to appropriateness of Entry apply to optional upload materials. The Entry and optional Entry materials shall sometimes be collectively referred to hereafter as the “Submission.”

Submission must be received by 11:59:59 pm PT on 9/30/08 to be considered. Other than as otherwise specified herein, neither Sponsor, nor anyone acting on its behalf, will enter into any communications with any entrant regarding this Contest or acknowledge or return any Submission received. Any Submission not meeting all Entry requirements stated herein will be void. The use of script, macro or automated devices (or any other devices intended to automate any aspect of entry) to enter Contest is prohibited and any Submission through such means will be void. In the event of a dispute as to the identity of an entrant based on the email address submitted, Submission will be awarded to the person named on the applicable Official Entry Form (regardless of whether that is the name of the authorized account holder of the email address from which said entry form was submitted), provided such individual is eligible according to these Official Rules. Released Parties are not responsible for late, lost, stolen, incomplete, misdirected, delayed, garbled, inaccurate, or undelivered Submissions, or for telephonic, human or computer failures, problems or errors, interruptions in service due to system upgrades, repairs, modifications or other causes, failures or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP), phones, phone lines or telephone systems, traffic congestion on the Internet, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of Submissions or the announcement of the prizes; or for any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Contest, or for printing, typographical, human or other errors appearing in these Official Rules or other Contest-related materials. Sponsor reserves the right, in its sole discretion, to void any Submissions of entrants whom Sponsor believes have attempted to tamper with or impair the administration, security, fairness or proper play of this Contest or are in violation of these Official Rules.

Round 1: Judging: A panel of independent judges identified & selected by Sponsor using its sole discretion, whose decisions will be final and binding in all matters relating to this Contest, will judge all Entries based on the following criteria: 1.) Originality: 0-30 points; 2.) Humor: 0-30 points; and 3.) Relevance to Theme: 0-40 points (the “Judging Criteria”). Subject to verification of eligibility and compliance with these Official Rules, the sixteen (16) Entries (8 male, 8 female) with the highest score, as determined by Sponsor and judges in their sole discretion, will be deemed “Round 1 Finalists” and will advance to Round 2. In the event of a tie in any category, such tied entries will be re-judged based on Relevance to Theme: 0-100 points. Potential Round 1 Finalists will be contacted by telephone and/or email. The sixteen (16) Round 1 Finalists will be required to execute and return an Affidavit of Eligibility & Liability & Publicity Release (where legal) within two (2) days of date of notification. Failure to comply within this time period, the inability to contact a potential Round 1 Finalist within the specified time period, failure to comply with these Official Rules or the return of such notification as undeliverable may result in forfeiture of place as a Round 1 Finalist and, at Sponsor’s discretion, a runner-up may be notified. Sponsor reserves the right to advance fewer than sixteen (16) Round 1 Finalists to Round 2 if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries.

Round 2: Peer Voting: Once the Round 1 Finalists have been selected by Sponsor, the applicable Entries will be posted online for peer voting at www.yoursmoothestline.com from 12:00:00 PM PT on 10/7/08 to 11:59:59 AM PT on 10/21/08 (“Round 2 Voting Period”). Entries should be voted on based on how well each Entry demonstrates Originality, Humor, and overall Entry Quality (“Voting Criteria”). There is a limit of (1) vote per person and per email address for the duration of the Round 2 Voting Period. Additional votes beyond the specified limit received from any one person or email address will be void. Votes generated by script, macro or other automated means or with the intent to affect the integrity of the peer voting process will be void. Round 1 Finalists are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Sponsor in its sole discretion. Subject to verification of eligibility and compliance with these Official Rules, the eight (8) Round 1 Finalists (4 male, 4 female) submitted that receive the highest number of valid votes, as determined by Sponsor, will be deemed “Round 2 Finalists” and move forward to the Round 3 Peer Voting. In the event of a tie, such tied Entries will be judged by a “tie-breaking” judge based on the Judging Criteria set forth above. Sponsor reserves the right to advance fewer than eight (8) Round 2 Finalists to the Round 3 Peer Voting if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries.

Round 3: Peer Voting: Once the eight (8) Round 2 Finalists have been determined, the applicable Entries will be posted online for peer voting at www.yoursmoothestline.com from 12:00:00 PM PT on 10/24/08 to 11:59:59 AM PT on 11/5/08 (“Round 3 Voting Period”). Entries should be voted on based on the Voting Criteria. There is a limit of (1) vote per person and per email address for the duration of the Round 3 Voting Period. Additional votes beyond the specified limit received from any one person or email address will be void. Votes generated by script, macro or other automated means or with the intent to affect the integrity of the peer voting process will be void. Round 2 Finalists are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Sponsor in its sole discretion. Subject to verification of eligibility and compliance with these Official Rules, the four (4) Round 2 Finalists (2 male, 2 female) submitted that receive the highest number of valid votes, as determined by Sponsor, will be deemed “Round 3 Finalists” and move forward to the Round 4 Peer Voting. In the event of a tie, such tied Entries will be judged by a “tie-breaking” judge based on the Judging Criteria set forth above. Sponsor reserves the right to advance fewer than four (4) Round 3 Finalists to the Round 4 Peer Voting if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries.

Round 4: Peer Voting: Once the Round 3 Finalists have been determined, the applicable Entries will be posted online for peer voting at www.yoursmoothestline.com from 12:00:00 PM PT on 11/7/08 to 11:59:59 AM PT on 12/15/08 (“Round 4 Voting Period”). Entries should be voted on based on the Voting Criteria. There is a limit of (1) vote per person and per email address for the duration of the Round 4 Voting Period. Additional votes beyond the specified limit received from any one person or email address will be void. Votes generated by script, macro or other automated means or with the intent to affect the integrity of the peer voting process will be void. Round 3 Finalists are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Sponsor in its sole discretion. Subject to verification of eligibility and compliance with these Official Rules, the two (2) Round 3 Finalist Entries (1 male, 1 female) submitted that receive the highest number of valid votes, as determined by Sponsor, will be deemed the Grand Prize winners. In the event of a tie, such tied Entries will be judged by a “tie-breaking” judge based on the Judging Criteria set forth above to determine the Grand Prize winners. Sponsor reserves the right to not award all Grand Prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries.

Potential Grand Prize winners will be notified by mail, telephone and/or email on or about 12/19/08. Return of any notification as undeliverable, Sponsor’s inability to contact a potential winner within a reasonable time period, or noncompliance with these Official Rules will result in forfeiture of prize and, at Sponsor’s sole discretion, a runner-up will be notified. Decisions of Sponsor are final and binding on all matters, including tabulation of votes.

Prizes: Sixteen (16) Round 1 Prizes: One (1) FUJIFILM Digital Camera (model to be determined by Sponsor) (Approximate Retail Value (“ARV”): $250). Two (2) Grand Prizes: A seven (7)-day/six (6)-night trip for winner and up to three (3) guests to Panama City, FL on dates to be determined by Sponsor. Trip consists of round-trip coach air transportation from major U.S. airport nearest winner’s residence, (2) standard double-occupancy hotel accommodations (two (2) rooms), ground transportation to/from the airport & the applicable hotel, and $500 spending money (awarded as a check) for winner only (ARV: $10,000). All federal, state, and local taxes and all other costs and expenses associated with acceptance and use of a prize not specified herein as being awarded are winners’ sole responsibility, including, but not limited to, additional transportation, meals, gratuities and souvenirs. Actual value of trip may vary depending on location of winner’s residence & final flight itineraries. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if winner lives within a 100-mile radius of Panama City, FL & no compensation or substitution will be provided for difference in prize value. Certain travel & accommodation restrictions may apply. Travel arrangements must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Winners and their respective guest(s) must travel together on the same itinerary & are responsible for obtaining all necessary travel documents. Winners must travel on dates designated by Sponsor or prize will be forfeited. Total ARV of all prizes: $38,000. All prize details are at Sponsor’s sole discretion and the Sponsor reserves the right to substitute the specified prizes with those of equivalent value at any time. Except where such exclusions are unenforceable under applicable laws or products come with a manufacturer's warranty, the prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, statutory or otherwise, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. Gift cards are subject to certain terms and conditions as specified by issuer. All federal, state and local taxes and any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winners. All prize details are at Sponsor’s sole discretion.

Miscellaneous: No transfer, assignment, cash redemption or substitution of prizes (or portion thereof) except by Sponsor who may substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. Potential winners may be required to execute and return an Affidavit of Eligibility, Liability and (where legal) Publicity Release within two (2) days of date of issuance of notification. Guests will each be required to execute a Liability and (where legal) Publicity Release prior to the issuance of travel documents. Each guest must be of legal age of majority in his/her state of residence (and at least 18) unless he/she is accompanied by a parent or legal guardian. If a guest is a minor, his/her parent or legal guardian must execute and return Liability/Publicity Release on his/her behalf. Noncompliance with the foregoing, with these Official Rules or any notification being returned as non-deliverable, may result in disqualification and, at Sponsor’s discretion and time permitting, a runner-up being chosen from the applicable Round. By entering, each entrant warrants and represents that his/her Entry submitted complies with these Official Rules, does not defame or otherwise violate or infringe upon the rights of any third party and does not violate any federal, state or local laws or ordinances. Entrants further warrant and represent that (1) they have secured the requisite consent from any third party referenced in their Entry (including, but not limited to, any company or other third party trademarks or logos or other third party content) and, if their Entry is a winner, agree to provide legal releases for the use of such reference in a form satisfactory to judges and Sponsor; (2) that other than those references for which entrant has provided legal releases, Sponsor shall own the Entries (and all material embodied therein); (3) that by entering, the entrant irrevocably assigns to Sponsor and its designees any and all rights, title and interest in the Entry, including but not limited to all intellectual property rights therein; and (4) that Sponsor and its designees shall have, without limitation, the perpetual right worldwide to edit, adapt, modify, publish, exploit and use the Entries and additional optional Entry materials in any way and in any and all media, offline or online at www.yoursmoothestline.com or any other site designated by Sponsor now or hereafter known for trade, advertising, promotional and/or other purposes as Sponsor and/or its designees may determine without further consideration, permission or notification to entrant, or any third parties. Entrant further agrees that (1) Entry shall become the exclusive property of Sponsor and will not be acknowledged or returned; (2) Sponsor and its designees shall have the right and permission to use (unless prohibited by law) entrant’s name, voice, city and state of residence, submitted Entry, photographs and/or likeness for advertising, trade, promotion and/or any other purpose or in any and all media now or hereafter known, anywhere in the world in perpetuity, without further compensation, permission or notification to entrant or any third parties and (3) the Released Parties shall have no liability and will be held harmless by entrant for any claim, action, liability, loss, injury or damage to entrant or any other person or entity, including, without limitation, personal injury or death to entrant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize and any travel or travel-related activity thereto or participation in this Contest or the use of any Entry or any of the rights granted herein. Released Parties are not responsible for any inability of the winners and/or Finalists to accept a prize and reserve the right, at their sole discretion, to disqualify or eliminate winners and/or Finalists and award prizes, time permitting, to the next runner-up for the applicable Round. Sponsor reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Contest (or portion thereof) should virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Contest and, in the case of termination, at its discretion, select the winners and/or Finalists for the Round(s) at issue from all eligible non-suspect Entries received prior to the event that required such termination using the judging procedure stated herein. CAUTION: Any attempt to deliberately damage or undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys’ fees) and/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.
